The humpback whale is listed as endangered under the ESA and depleted under the MMPA: any harvest, including subsistence, is now prohibited, and other causes of human-caused mortality monitored and managed. Currently a draft petition to delist humpback whales is being reviewed. While delisting humpback whales will remove the protection from the ESA, recreational and commercial harvest would remain prohibited under the MMPA except with limited subsistence harvesting.
